Adult Dependent Relative

Adult Dependent Relative

(Parents, grandparents & extended family)

This route, known as the Adult Dependent Route, permits non-EEA national adult dependents of British citizens or those settled in the UK to settle in the country. Eligibility requires proof that the dependent requires long-term personal care due to age, illness, or disability that can be provided by their relative in the UK without public funds. Applicants must apply from outside the UK and cannot switch to this route while in the country.

To qualify for this route, applicants must be incapable of performing everyday tasks, such as washing, dressing, and cooking, due to their condition. The required level of care must be objectively assessed by a doctor or health professional, taking into account the applicant’s physical, emotional, and psychological needs. Furthermore, the applicant must be unable to obtain the required level of care in the country where they reside, even with their sponsor’s financial and practical help in the UK. This could be due to the lack of availability or affordability of such care.

The Entry Clearance Officer will consider whether another person in the applicant’s home country can reasonably provide the care required. This could be a family member, friend, or caregiver. If the care is available or affordable in the applicant’s home country, the application may be refused. The accommodation in which the applicant will reside in the UK must be owned or exclusively occupied by the sponsor, who must sign a 5-year undertaking to maintain, accommodate, and care for the applicant without public funds.

In summary, to qualify for the Adult Dependent Route, the applicant must require long-term personal care due to age, illness, or disability, and be unable to obtain the required level of care in their home country. The sponsor must be able to adequately maintain, accommodate, and care for the applicant in the UK without public funds.
